The task, however, was not easy. “They approached us in August 2010. First, they wanted an egg donor from their own country. But that didn’t work out. So in October, we fertilized eggs from an Indian donor with Alan’s sperm. The embryos were implanted in a surrogate mother from the city,” said Dr Gautam Allahbadia, medical director of the center. “They became parents of a boy and a girl on May 1. Going by the Indian Council of Medical Research guidelines, the couple will not have any legal problem taking the children back home.”
“This is the first case of a speech and hearing impaired gay couple realising their dream of having children through a surrogate mother,” said Dr Gautam Allahbadia, an in-vitro fertilisation expert and medical director of Rutunda Clinic, Bandra.The mother is an unidentified Indian woman who donated her egg. It was subsequently transferred to a surrogate who delivered the babies on May 1.
Dr Allahbadia said the clinic receives requests from around 20 gay couples every year from the UK, US, Australia and Spain.”We’ve named our babies Sela and Seth,” said Alan, adding that the babies have Indian features. The couple seem to fuss over the kids more than “normal parents” would, a doctor at the center said. Explaining why they are more worried than usual, Brian said, “As the babies have genes of biological parents belonging to two different geographical areas, we don’t know what factors the kids would be sensitive to. For example, it is quite warm here in India, but once we return to the US, the climate is not going to be the same.”

‘Foreign nationals need to consult consulates on surrogacy’
Over the years, India has emerged as a top global destination for surrogacy but there’s also been growing international concern about how surrogacy is practiced here.
Thousands of foreigners head to India each year to initiate a process of surrogacy at one of India’s In Vitro Fertilisation (IVF) clinics. Very often their dream of becoming a parent is fulfilled here only to be thwarted back home in their country of origin which may or may not recognise surrogacy.
Baby Manjhi, for instance, was trapped in a long legal battle. Her parents, a Japanese couple, were divorced after she was conceived by a surrogate Indian mother. Since the Indian law does not grant single men custody of a girl child, her father had to wait for three months to take her home.
Later, twins born to a surrogate mother in India were adopted by a gay Israeli man but they were denied Israeli citizenship for months.Now, a French national may lose his twin sons because surrogacy is not legally accepted in France.
Such cases prompted the consul generals of eight European countries to send a letter to IVF clinics in Mumbai stating that the clinics must direct foreigners to get clearances from their embassies before initiating the surrogacy process.
This is already stated in Indian Council of Medical Research (ICMR) guidelines .
IVF expert Dr Gautam Allahabadia of Rotunda in Bandra is of the opinion that the European consulates are hoping to avoid tricky nationality issues by alerting IVF clinics.
This move has come as a surprise to the medical community and IVF clinics despite the growing international concern over commercial surrogacy.
